RULES & CONDITIONS OF MEMBERSHIP
IMPORTANT: If you want to become a member (hereinafter, referred to as The Member, this includes all memberships/day visitors/Trial Members) of the club then you should read the following terms and conditions of membership carefully. ALL Members are bound by the same rules. Acceptance of membership shall denote a binding contractual agreement between The Member and The Club based on these terms and conditions of membership. We may make reasonable changes to these Terms at any time.
Right of Admission is reserved. B-Active Health & Fitness Centre (hereinafter referred to as The Club) reserve the right to refuse entry to anyone who’s behaviour or appearance is deemed to be unsuitable and to cancel/withdraw (with appropriate refund if applicable) any membership which management feels is of detrimental value to The Club.
a. Available to anyone aged over 16 years or 14 years if accompanied by an adult member; subject to the acceptance of his or her application.
b. Acceptance of membership shall denote a binding contractual agreement between The Member and The Club based on these terms and conditions of membership.
c. You shall remain a Member for a minimum period of 30 days after which your membership will be automatically renewed monthly at the Club's discretion until such time that a cancellation (please see Point 3) is received from you.
d. Members are to inform The Club as soon possible of any change of contact/bank details.
e. The Club may transfer the benefit of this agreement to a third party at any time without notice to you. Your rights under this agreement will not be prejudiced.
f. Your membership starts immediately.
g. You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
h. This agreement is governed by English Law.
i. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.
j. If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
2. Membership cards:
a. Each member will be issued with a membership card; which must be used each time a member enters the club.
b. There will be a charge of £1.50 for the replacement of a lost membership card.
c. Membership is personal and is not transferrable to another person.
3. Cancellation of membership:
a. You may cancel your membership at any time with 30 days notice. Should you cancel your direct debit, your membership will automatically be cancelled but you will still be liable to pay the 30 day notice. You can email [email protected] with details of your cancellation. Forms are also available at reception but be sure to ask for a cancellation receipt as no refunds will be considered without one. Do not cancel your direct debit, we will cancel it after the 30 day notice. You are encouraged to use the facilities for the period you have paid for.
b. We do not accept telephone/verbal cancellations. All cancellations must be in writing.
c. Joining/Administration fees are non-refundable. Members who took advantage of a "No Joining Fee" promotion, will be liable to pay a joining/administration fee should they cancel or allow their membership to lapse and then re-join.
d. Refunds will not be considered without acceptable proof of cancellation.
- B-active Health & Fitness Centre shall be entitled to vary subscription from time to time and will notify members prior to such variation.
a. Members understand that they shall be liable for any bank charges incurred should their payment fail.
b. Subscriptions are paid for in advance and will be collected on or around the first of each month.
c. B-active Health & Fitness Centre reserve the right to change/modify pricing of new/non contract memberships.
d. Members will be notified of any applicable changes to existing memberships.
e. Under no circumstances will any amounts paid be refunded unless an error has occurred on the part of The Club. This includes non use of the facilities or failing to cancel your membership.
f. ALL memberships are paid by direct debit except yearly, which are paid in advance. There are no exceptions or deviations.
6. Opening Hours
a. The Club is open at the following times: Monday through Friday 6:00am - 10:00pm, Saturday 7:00am - 8:00pm Sunday 8:00am – 8:00pm, Bank Holidays: 9:00am - 6:00pm and will be closed on certain bank holidays with an annual early close for our staff Christmas dinner in December.
b. The opening and closing times of the club may vary from time to time at B-active Health & Fitness Centre’s discretion. Any variation will be displayed at the club reception.
c. Members agree to vacate the premises by closing time.
a. The Club has the right to add/change/modify the facilities from time to time in line with business trends or for the good of the facility.
b. The Club may, at any time, withdraw all or any part of facilities for other activities as in connection with repair, alteration or maintenance work.
c. The use of the sauna (if available) is an added benefit and does not construe part of membership. The privilege of using the sauna may be revoked for any member who does not adhere to the rules and etiquette pertaining to the use of the sauna which could include a complete withdrawal of membership to The Club (see point 8. Sauna)
a. The sauna is to be booked at reception for the time you wish to sauna. The sauna will be heated for 30 minutes and will then be switched off.
b. Shower before you sauna.
c. Do not eat in the sauna.
d. Wear a swimsuit or suitable attire. Two hourly safety checks are conducted by male and female staff members. Be sure you are covered up.
e. Sit on a clean towel.
f. Clean your seat before and after use.
g. Do not wear outdoor shoes. “shower shoes” (example: clean flip flops) permitted.
h. Do not exercise/shave/wash/exfoliate in the sauna.
i. No body lotions/oils/gels/creams or any other type of substance which could be a slip hazard, is to be used in the sauna.
j. Do not leave the door open.
k. Do not place any flammable items near the stove.
l. Do not exceed 10 minutes per session. There is a timer to assist you.
m. Only one person permitted in the sauna unless you are close contacts or all parties agree to share the sauna.
n. If you are new to the sauna experience, do not exceed 5 minutes, sit on the lower bench and do not lie down.
o. Do not use the sauna if you are pregnant, have a skin disorder that is aggravated by heat/humidity; are suffering from a skin infection, have an open wound or have respiratory disorders (including cold/cough/flu), suffer from a heart disorder, have abnormal low/high blood pressure or circulatory problems; are a diabetic, suffer from excess fluid retention or epilepsy or are prone to fainting spells or dizziness.
p. Do not use the sauna if you are undergoing medical treatment without the prior consent of your physician.
q. Never use the sauna whilst under the influence of drugs/alcohol.
r. If you have had a heavy meal, wait at least 4 hours before entering the sauna as not doing so could cause nausea and vomiting.
s. Do not pour excessive amounts of water on the coals. It is a sauna not a steam room.
t. The sauna cannot cure a hangover. On the contrary it will dehydrate you, making you feel worse.
u. Do not leave anything in the sauna.
v. All articles of jewellery such as bracelets, watches and rings should be removed before entering the sauna.
w. If feeling unwell, leave the sauna immediately.
9. Conduct/Gym Rules:
a. Proper athletic attire must be worn (no jeans, street shoes, sandals etc.) in the gym area.
b. Shirts must be worn at all times and no underwear, midriffs, bare buttocks or chests to be visible in the gym area.
c. Members are to practice acceptable hygiene practices by wearing clean clothing and using anti-perspirant/deodorant so as not to offend others in the facility.
d. Members must show consideration for one another and The Club’s staff: Unnecessary grunting, shouting, the use of offensive language/abusive language, swearing/cussing, intimidation tactics or the threat of violence will not be tolerated.
e. Re-rack weights (plates and dumbbells) and strip down bars after use and return to their proper locations. All other accessories to be returned to their correct locations. Failing to do so may incur additional charges to your membership or may result in a suspension without refund.
f. The premises (including changing rooms) to be vacated willingly by official closing time.
g. All personal belongings must be secured in lockers. Bags are not allowed in the gym and reception is not permitted to hold member’s goods or personal belongings.
h. Equipment to be wiped down after use.
i. Wet shaving is not allowed in the changing rooms.
j. Dropping of weights/disrespect of gym property could result in membership suspension.
k. Monopolizing pieces of equipment is not acceptable.
l. Weight machines must be shared at all times. Please yield to others between sets.
m. Any type of smoking is not permitted anywhere on the premises, inside or outside.
n. Personal music must be kept at a level inoffensive to others.
o. All new members should make an appointment with an instructor, so a Fitness assessment or a suitable and safe exercise programme can be prepared.
p. Members, who do not undertake an exercise induction, exercise at their own risk.
q. Members are to utilize the equipment in the manner it was designed to be used; The Club will not accept responsibility for the incorrect use of equipment/facilities. If in doubt regarding correct utilization; members are to please speak with a member of The Club for assistance.
r. The consuming of alcoholic beverages and illegal substances will not be tolerated. Members will not be permitted to access the facility if intoxicated or under the influence of any illegal substance.
s. Members are to treat each other and The Club's staff with the same respect they wish to receive.
t. Conducting solicitation or transacting any business (e.g. Personal training, selling of nutritional products or any other product or service) is prohibited within the facility.
u. No animals allowed (except guide dogs assisting a disabled person)
v. Loan or use of another member’s card will result in automatic revocation of membership without refund.
w. Members are expected to exercise common sense during visits to the facility.
x. Any unauthorized postings of flyers/advertisements in any part of the facility will be removed.
a. Members are not to use the facilities should they show any symptoms of illness or if they feel generally unwell; if suffering from any contagious disease/illness/injury/similar which may cause discomfort or pose a health risk to other Members/Staff of the facility.
b. Members agree to respect social distancing rules and other members and staff's personal social distancing practices.
c. Members agree to sanitise their hands upon entering the gym or wash their hands prior to training.
d. Members agree to adhere to the signage relating to safe practices during their time in the facility.
e. The Club reserves the right to turn away any person showing symptoms of being unwell.
a. Members are responsible for their personal belongings and The Club shall not be liable for any loss, damage or theft of personal property unless due to negligence or omission on The Club's behalf.
b. The Club shall not be responsible for any death, injury to any Member or persons/children accompanying them on site.
c. Children are not permitted in the gym areas at any time and must be supervised by an adult if in reception or visiting a Renter on the upper floor.
d. It is recommended you undergo a medical examination to ascertain you are not at any type of risk by the exercises/activities you wish to participate in.
e. The taking of photographs or videos is not permitted anywhere in the facility unless in a designated photo-opp.
f. The use of mobile phones in the changing rooms is not permitted.
12. Acceptance of Membership:
a. Upon acceptance of your application, you certify all details you have provided are true and correct.
b. You agree to comply with these Rules & Conditions of Membership contained herein and which are also displayed prominently in the Club relating to opening hours, use of facilities, conduct etc. We may make reasonable changes to these Rules at any time. (If deemed necessary: reasonable notice will be provided).
c. You understand that by not complying with the current rules and regulations of membership, your membership may be revoked/suspended and any future access denied.
The Club will not sell/trade or use your personal information for anything other than fulfilling their commitment to you or to inform you of important changes or providing information we think may be of interest to you.
